ASIC looking to regulate overseas ICOs under Australian laws

Australian regulations may apply to ICOs, even when created and offered overseas, warns commissioner. ASIC will be eyeing initial coin offerings (ICOs) as it moves to update its guidelines for companies raising funds by issuing digital currencies or tokens. Specifically, it warns that Australian laws may apply to ICOs even when they’re created and offered from overseas. “We will highlight that Australian corporate and consumer law might apply – even if the ICO is created and offered from overseas,” said ASIC Commissioner John Price at a Sydney fintech event. “This is an important point given the international nature of this sector. How Australia is becoming a cryptocurrency continent: Markets, Regulations and Plans

The very nature of cryptocurrencies dictate that regulation, control, and by extension, a centralized system, do not fit in with what they stand for. They are supposed to be totally decentralized, and therefore not dictated by many rules. This made a lot of sense when cryptocurrencies were not in the spotlight, and not a major factor on the world stage. However, as mainstream adoption has increased, and more individuals have entered the market, so has the interest from governments and regulators around the world. This has culminated with the G20 summit sitting down and discussing how to fit this decentralized financial system into today’s global society. However, one nation is […]

Fintech heads list of growth companies across Asia-Pacific

When Prospa launched in Australia in 2011, the online lender to small companies had an intimidating task before it: taking business from the country’s biggest banks. Small companies in search of working capital had long relied on traditional lenders, before the global financial crisis curtailed banks’ appetite for risk. Seven years on, Prospa has topped this inaugural list of high-growth companies, in revenue terms, from the Asia-Pacific region. The expansion of digital services combined with a desire for flexible financing fuelled Prospa’s growth. It is hardly a lone disrupter. Hot on its heels at the top of the list are New Zealand-based fintech firms Pushpay, a mobile payments service, and […]

Blockchain is ready for prime time despite its critics

By John Heaton – Moneycatcha CTO Over the last few years the hype around Blockchain has been brought to the forefront via mass entry into cryptocurrencies. This is not too dissimilar to when online trading systems became publicly available in the late 1990s early 2000s.  The pattern of behaviour is similar with an opportunity being presented and individuals trying to make a return on investment.  As with the online trading systems, there will be individuals who manage to make significant returns on investment but the vast majority made marginal or no returns. Before technology is fully commercialised it endures certain growing pains such as awareness, decision to adopt, initial use […]

Bitcoin finds a bottom as risk aversion grips global markets

What’s supposed to be the most volatile asset in the universe is proving to be a bastion of stability compared with wild swings and carnage in global equities this week. Bitcoin clawed its way back from the four-month low of $US5922 it touched on Tuesday, rebounding almost 45 per cent to $US8500. The S&P 500 Index and the Dow Jones Industrial Average both fell more than 5 per cent this week, wiping out gains for the year. Emerging markets stocks and currencies also plunged, while shorter maturity US Treasuries climbed as investors fled from risky assets to safe-havens. Bitcoin’s supporters are quick to extol the cryptocurrency’ virtues as an asset […]
